1. Introduction

Top Shelf (“we”, “our”, or “us”) is operated by EC TECH LLC, a Washington State limited liability company. We are committed to protecting your personal information and being transparent about how we collect, use, store, and share it. This Privacy Policy explains what data we collect, why we collect it, how we use and share it, and your rights regarding that data.

By using Top Shelf, you agree to the collection, use, storage, and sharing of information in accordance with this policy. If you do not agree with this policy, please do not use our service.

2. Age Requirement

Top Shelf is a platform intended for adults of legal drinking age in their country of residence. By creating an account, you confirm that you are of legal drinking age in your country and that you are at least 13 years of age. Age verification relies on user self-certification at account creation. We do not employ third-party age verification services at this time. We do not knowingly collect personal information from individuals below the legal drinking age in their jurisdiction. Separately, we do not knowingly collect personal information from children under the age of 13, as described further in Section 11. If we become aware that we have collected data from either category of individual, we will delete that information as soon as reasonably practicable.

3. Information We Collect

We collect the following categories of information:

3.1 Account Information

When you create an account, we collect your email address, display name, and username. Account creation and authentication is handled by Clerk, Inc. on our behalf. We may also store a short user-provided biography if you choose to add one to your profile. Your email address is used to send transactional communications including your welcome email upon account creation.

3.2 Taste Profile and Preferences

During onboarding, we ask you a series of questions about your spirit preferences, including preferred categories, drinking style, flavor preferences, alcohol strength sensitivity, and typical price range. You may skip the onboarding quiz entirely, in which case no taste profile will be created. If you choose to skip, we store a record that you have skipped the onboarding quiz in order to avoid prompting you again. If completed, this information is stored as your taste profile and is used solely to personalize your experience and recommendations within Top Shelf. You may update this information at any time through your account settings via the My Taste Profile option.

3.3 User-Generated Content

We collect and store content you actively create on Top Shelf, including spirit ratings and reviews, tasting notes and flavor tags, lists, and author notes added to list entries. Ratings and reviews are visible to all visitors to Top Shelf regardless of account status. Lists are visible to others only if you explicitly choose to make them public. Author notes on list entries are visible only to users who have access to the list — private lists restrict this to the owner only. Feedback submitted through the app is transmitted to our internal team via Slack and is not displayed publicly. Bottle requests submitted through the app are logged and reviewed periodically by our team and are not displayed publicly.

We also store bottles you have liked and lists or collections you have bookmarked. This information is used solely to personalize your experience within Top Shelf and is not shared publicly or with third parties.

3.4 Usage Data and Analytics

We use PostHog to collect usage analytics to understand how our users interact with Top Shelf. This may include pages visited, features used, search queries entered in the Browse page, and general interaction patterns. Analytics events are associated with your account identifier, which can be linked back to your account, and are used solely for product improvement purposes. We do not sell this data. You may opt out of analytics data collection at any time through the Analytics & Data setting in your account preferences. When you opt out, no further analytics events will be captured. Previously collected analytics data will not be retroactively deleted unless you submit a deletion request under Section 8.

3.5 Error and Performance Data

We use Sentry to monitor application errors and performance issues. When an error occurs, Sentry may capture technical information including your account identifier, email address, username, the page or action that triggered the error, and technical information about your device and browser such as device type, operating system, browser version, and IP address. IP addresses captured by Sentry are used solely for error diagnosis and are not stored beyond Sentry's standard retention period. This data is used solely for diagnosing and fixing bugs and is never used for marketing purposes.

3.6 Feedback Submissions

When you submit feedback, bug reports, or feature requests through the in-app feedback form, the content of your message and your account identifier are transmitted to our internal team via Slack Technologies, Inc. This information is used solely to review and respond to your feedback. Slack is bound by its own privacy policy available at slack.com/privacy-policy. We do not use feedback content for any purpose other than improving the service.

4. How We Use Your Information

We use the information we collect for the following purposes:

  • To create and maintain your account and authenticate your identity
  • To send you a welcome email upon account creation
  • To personalize your spirit recommendations based on your taste profile
  • To display your ratings and reviews to all visitors, and your lists to you and, where you have chosen to make them public, to other users
  • To improve the Top Shelf platform through usage analytics
  • To diagnose and resolve technical issues using error monitoring
  • To respond to feedback, bug reports, and support requests
  • To enforce our Terms of Service and age requirements

5. How We Share Your Information

We do not sell, rent, or trade your personal information to third parties for marketing purposes. We may share your information only in the following limited circumstances:

  • With service providers who process data on our behalf (Clerk for authentication, PostHog for analytics, Sentry for error monitoring, Slack for internal feedback routing, Vercel for hosting) — each operating under terms that include data processing commitments
  • With other Top Shelf users for ratings and reviews you submit, which are visible to all visitors on bottle detail pages, and for lists you have chosen to make public
  • When required by law, regulation, or valid legal process
  • To protect the rights, property, or safety of EC TECH LLC, our users, or the public
  • In connection with a merger, acquisition, or sale of assets, in which case you will be notified with reasonable advance notice via the email address associated with your account prior to any such transfer

6. Cookies and Local Storage

Top Shelf uses browser cookies and local storage for the following purposes:

  • Authentication session management via Clerk, which uses both cookies and local storage
  • Storing your theme preference (light or dark mode)
  • Storing your analytics cookie consent preference in local storage so we do not ask you repeatedly
  • Storing your age verification confirmation in local storage so we do not ask you repeatedly on the same device
  • Analytics tracking via PostHog, subject to your consent preference

You can control cookie and analytics preferences through your browser settings and through the Analytics & Data toggle in your account settings. Disabling authentication cookies will prevent you from signing in to Top Shelf. Disabling other cookies may affect additional functionality.

Top Shelf does not currently respond to browser Do Not Track signals. You may opt out of analytics tracking through your account settings regardless of your browser's Do Not Track setting.

7. Data Retention

We retain your personal information for as long as your account is active or as needed to provide our services. If you delete your account, we will acknowledge your deletion request within 30 days and complete the deletion of your personal identifiers — including your name, email address, username, and taste profile — within 90 days. We will submit deletion requests to PostHog and Sentry using their respective data deletion tools within the same 90-day window, subject to those providers' own deletion processes and timelines. Lists you have created will be deleted within the same 90-day window. Users who have bookmarked your lists will no longer be able to access them after your account is deleted. Bookmarks you have saved to other users' lists or Top Shelf collections will also be deleted within the same 90-day window.

Reviews and ratings you have submitted may be retained in anonymized form, attributed to a deleted account, to preserve the integrity of our spirits catalog. Once anonymized, this content can no longer be linked to your identity in any way. We are not able to recover or re-associate anonymized content with a deleted account. Anonymized analytics data — meaning aggregate usage data from which your identity has been removed — may be retained indefinitely for product improvement purposes. Where we are required to retain certain information for legal, tax, or regulatory purposes, we will do so for the minimum period required by applicable law.

8. Your Rights and Choices

Depending on your location, you may have the following rights regarding your personal information. We currently handle these requests manually — please contact us and we will work with you directly to fulfill your request. Residents of Washington State may have additional rights under applicable state law. For more information about Washington State privacy rights, residents may contact us directly at privacy@top-shelf.app.

  • Access — request a summary of the personal data we hold about you
  • Correction — request that we correct inaccurate or incomplete data. Note that you may update most of your profile information directly through your account settings
  • Deletion — request that we delete your personal data and account. Note that anonymized reviews may be retained as described in Section 7
  • Portability — request your data in a portable format where technically feasible
  • Opt-out of analytics — disable usage data collection through your account settings at any time
  • Withdraw consent — where processing is based on consent, you may withdraw it at any time without affecting the lawfulness of processing based on consent before its withdrawal

California Residents

California residents may have additional rights under the California Consumer Privacy Act (CCPA), including the right to know what personal information is collected and how it is used and shared, the right to delete personal information, the right to opt-out of the sale of personal information, and the right to non-discrimination for exercising your privacy rights. We do not sell personal information. California residents may exercise their rights by contacting us at privacy@top-shelf.app.

To exercise any of your rights, please contact us at privacy@top-shelf.app. We will respond to all requests within 30 days, or within the timeframe required by applicable law.

9. Data Security

We take reasonable technical and organizational measures to protect your personal information against unauthorized access, alteration, disclosure, or destruction. These measures include encrypted data transmission via HTTPS, secure authentication through Clerk, limiting access to user data to authorized personnel who require it to operate and improve the service, and error monitoring to detect and respond to security incidents promptly. However, no method of transmission over the internet or electronic storage is 100% secure. We cannot guarantee absolute security and encourage you to use a strong, unique password for your account.

In the event of a data breach affecting your personal information, we will notify you via the email address associated with your account as required by applicable law and as soon as reasonably practicable.

10. Third-Party Services

Top Shelf integrates with the following third-party services, each governed by their own privacy policies:

  • Clerk (clerk.com) — authentication and user account management
  • PostHog (posthog.com) — product analytics
  • Sentry (sentry.io) — error monitoring and performance tracking
  • Slack (slack.com) — internal routing of user feedback submissions
  • Vercel (vercel.com) — application hosting and deployment

We encourage you to review the privacy policies of these services to understand how they handle your data.

11. Children's Privacy

Top Shelf is not directed at children under the age of 13. We do not knowingly collect personal information from children under 13. If you are under 13, please do not use Top Shelf or provide any information to us. If we become aware that we have collected personal information from a child under 13 without the knowledge of a parent or guardian, we will take steps to delete that information as soon as reasonably practicable. 12. International Data Transfers

EC TECH LLC is based in Washington State, United States. If you access Top Shelf from outside the United States, your information may be transferred to, stored, and processed in the United States or other countries where our service providers operate. We rely on the data processing agreements and standard contractual clauses maintained by our service providers — including Clerk, PostHog, Sentry, and Vercel — to ensure that any international transfers of your personal data are conducted in compliance with applicable data protection laws.

13. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors. When we make material changes, we will update the “Last updated” date at the top of this page and notify you via the email address associated with your account at least 14 days prior to the changes taking effect. For material changes, we may require you to affirmatively acknowledge the updated policy before continuing to use the service. We encourage you to review this policy periodically. For non-material changes, your continued use of Top Shelf after the updated policy has been posted constitutes your acceptance of the changes.
